As a creditor, our priority is to ensure your interests are upheld and funds recovered. Whether through forensic investigation, asset tracing, enforcement and insolvency, dispute resolution or simple debt recovery, discover the ways our pragmatic expertise can support you.

How we can help

Our experienced creditor services team support with:

  • Retention of title

If you have supplied goods to a distressed or insolvent business, and have not received payment in full, we can advise you on the options available and assist in making a retention of title claim.

Our team will provide assistance through the process, including managing third parties, recovering funds owed or a return of stock supplier reviews. Where a supplier has concerns about credit already advanced to the business, we can assess recent and anticipated financial performance and creditworthiness of a business.

  • Investigations

If appointed in an insolvency process, we will assess, highlight and pursue claims including transactions at undervalue, preferences, fraudulent and wrongful trading as well as misfeasance and unlawful dividends.

  • Officeholder monitoring

Following an appointment, we will monitor recoverability and dividend prospects, case progression, fee resolutions sought together with representation on an appointed creditors’ committee. We report back to clients on a quarterly basis to support internal credit and profit/loss procedures in relation to S&W insolvency appointments.

  • Advice to landlords

We can assist with a proposed restructuring of a tenant, including voting rights in formal restructuring or insolvency, disclaimer of onerous leases, the rights of occupation post insolvency  and the rights of enforcement, such as distraint and forfeiture.

  • Tenant services

Including quantification of landlord claims in restructuring, assessment of solvency and the impact of onerous leases, as well as assistance in negotiated settlements.

“I have worked with the creditor services team at S&W for several years and found them to be very personable and knowledgeable. When they have represented us at creditors meetings, they ensure that everyone understands what is being said, something no one else does. The level of trust they have internally here is a credit to them and the relationship that has been fostered.”
